JURISDICTIONAL PROBLEMS CORRUPTION COURT DECISION APPLYING PENALTY PENALTY UNDER SPECIAL CRIMINAL

Abstract:

This study aims to find out and analyze Juridical Problems with the Decision of the Corruption Court that Appoints Special Minimum Criminal Penalty Sanctions, as well as to identify and analyze Judges imposing criminal sanctions under Special Minimum Crimes in cases of Corruption Crime. The method used to examine and analyze the problem is used normative legal research methods with the approach of invitation legislation. The results of the study show that. The enactment of minimum criminal in the Act of corruption is not accompanied by the provision of rules or guidelines for punishment which is a special rule outside the Criminal Code which includes a minimum criminal specifically in the article formula.
